Abstract:

It is an unfortunate fact that differences of opinion can occur and occasioanlly cannot easily be resolved. One party is right and both know who it is. Dispute resolution, either through the Court or through mediation/arbitration is time consuming, expensive, and usually no one is particularly happy at the end of it. What can be done to mitigate the potential for disputes, and how can you prepare yourself to have the most satisfactory outcome? What does the Court process entail, how does it impact the company executives and how do you find the closet with the skeletons. What are the potential outcomes of such a proceeding and when do you swallow your pride and reach a settlement?
